The committee follows the guidelines laid down by the Hon’ble Supreme Court of India in the Vishakha Judgment and the PoSH Act.

Purpose of the Committee

The Committee aims to prevent inappropriate behavior of a sexual nature and ensures that no form of harassment or retaliation is tolerated at IPHH College of Nursing & Allied Health Sciences, Jammu. It provides a structured mechanism for filing complaints and resolving cases with fairness, transparency, and confidentiality.

What Constitutes Sexual Harassment?

As per Supreme Court guidelines, sexual harassment includes:

  • Unwelcome physical contact and advances
  • Sexually colored remarks
  • Demands for sexual favors
  • Display of pornography
  • Verbal, physical, or non-verbal conduct of a sexual nature

Additionally, acts such as eve-teasing, sexist jokes, unwanted touching, offensive pictures, or invasion of privacy also fall under sexual harassment.

Roles & Authority of the Committee

The Committee:

  • Reviews complaints to determine whether a case of sexual harassment exists
  • Conducts investigations, records evidence, and hears both parties
  • Recommends disciplinary action for harassment, retaliation, or false complaints
  • May summon documents, witnesses, or electronic records
  • Ensures emotional, psychological, or physical support for the victim

Procedure

Complaints may be lodged by the victim or a third party through a written submission to the Committee Convener. Proceedings follow natural justice principles, and recommendations are forwarded to management for final action.
